LEGAL INFORMATION
TERMS & CONDITIONS.
Proposed terms for 1:1 remote coaching for adult private clients. Contract language: English.
1. Provider and scope
These terms concern 1:1 remote coaching supplied by 3 STEPS BEYOND LTD, represented by Kenan Mujezinovic. Provider details are in the Legal Notice. They do not cover gym memberships, retreats or separate courses.
The service is intended for adults acting as private consumers. Mandatory protections that apply in your country remain unaffected.
2. Application and agreement
An application is a non-binding request to discuss coaching. It does not create a paid contract, reserve a start date or require payment.
After personal review and discussion, we provide an individual offer and a Stripe-hosted checkout link. Before you place a paid order, the service, total price including applicable taxes, payment schedule, duration, start arrangements, these terms and withdrawal information must be available to you. The contract is concluded when you accept that offer and these terms in the checkout and successfully complete the required payment. We then provide confirmation in a format you can keep.
3. The coaching service
The programme starts with a health, lifestyle and movement assessment. Kenan sets an individual training programme, nutrition guidance and practical health targets based on your starting point and goals. Coaching includes weekly check-ins, personal feedback, direct support and a monthly 30-minute 1:1 review call.
The regular rhythm is your Sunday check-in and Kenan’s Monday feedback. The usual message response window is around 24 hours on weekdays. The coaching app holds the programme, targets, logs and communication. This is remote coaching; supervised live training sessions are not implied.
Specific requirements, available equipment, scheduling and any agreed variation are recorded in your offer. Results depend on individual factors and participation; no specific physical result or rate of progress is guaranteed.
4. Initial phase and continuation
The initial coaching phase is 12 weeks, with the start date specified in your agreement. It does not renew automatically. Any continuation requires a new offer setting out the next phase, its duration and price, and your express agreement before it starts.
Mandatory rights to withdraw or terminate for a legally recognised reason remain unaffected. Any longer interruption affecting the coaching period must be discussed and recorded separately; rescheduling a review call does not automatically change the programme’s duration or payment dates.
5. Price and payment
The total fee, applicable taxes, instalments, due dates and accepted payment method are stated in the written offer before acceptance. Applying does not trigger a charge.
Payment arrangements are provided separately with your individual offer. Where Stripe is used, payment takes place through its hosted checkout. The public application does not collect payment details or start a paid order. Any agreed instalments are a defined payment plan for the initial phase, not permission for open-ended renewal charges. This website does not process paid orders. Statutory remedies remain unaffected.
6. Participation and safe training
Provide accurate relevant information, follow the agreed plan and give honest feedback. Tell Kenan about material changes affecting safe participation. Use suitable equipment and a safe environment; stop an activity if it causes pain, dizziness or other warning signs and seek appropriate medical advice.
Coaching, mental-performance guidance and sports-nutrition advice do not replace diagnosis, medical treatment, psychotherapy or emergency care. Where appropriate, obtain medical clearance before beginning or continuing an activity. Do not use coaching messages for urgent medical needs.
These responsibilities do not waive any legal right or excuse a failure to exercise the care required of the coach.
7. Calls, changes and interruptions
Review calls are arranged by agreement, using Calendly where appropriate. You may reschedule a call by giving at least 24 hours’ notice before its scheduled start. If you cancel with less than 24 hours’ notice or do not attend, that call is counted as used within your coaching package.
If illness prevents you from attending, tell Kenan as soon as possible and the call will be rescheduled instead. You do not need to include diagnoses in booking messages. If Kenan cannot deliver a call, it will be rescheduled without being counted as used.
This scheduling rule is subject to mandatory law. Counting a missed appointment as used does not mean that the complete coaching service has been fully performed or that your statutory withdrawal or other consumer rights have ended.
8. Withdrawal and statutory remedies
Consumers may have a statutory right to withdraw from a distance contract. For the proposed EU consumer notice and model form, see Withdrawal Information. Starting coaching does not automatically remove that right.
Any request to start during the withdrawal period must be handled separately with the information and consent required by applicable law. Nothing here restricts statutory rights where the service is not provided as agreed.
9. Liability
Liability is governed by applicable law. Nothing in these terms excludes or limits liability where the law does not permit it, including liability for death or personal injury caused by negligence, fraud or intentional misconduct.
There is no blanket waiver of injury claims and no general liability cap based on the price of the programme in this draft.
10. Materials and client content
Coaching materials and programme content are supplied for your personal use. Do not sell or redistribute them or give others access to your coaching account. Statutory rights and any separate written permission remain unaffected.
You keep your rights in material you provide. Photos, messages or testimonials will not be published for promotion without a separate appropriate permission.
11. Data protection
The Privacy Policy explains data handling. Entering a contract or reading these terms does not itself give blanket consent to every use of personal data. Any required consent for health information or promotional use is obtained separately.
12. Law, complaints and changes
The proposed governing law is the law of the Republic of Cyprus. This does not deprive consumers of mandatory protections applicable under the law of their country of habitual residence, where those protections apply. Mandatory jurisdiction rights also remain unaffected; no exclusive Larnaca court clause is imposed on consumers here.
Send complaints to hello@3stepsbeyond.de. Applicable access to courts and competent dispute-resolution mechanisms remains unaffected.
Publishing a new version of these terms does not automatically change an existing contract. Any changes to an existing agreement require a lawful basis and the process applicable to that agreement.
